IMPORTANT***Injunction Notice***
Dear all..
I have just been speaking to SGT James Oliver from Mansfield Police who has been explaining the issue with what has been in the news lately... Below is the INJUNCTION, please read carefully...
In no way is this going to affect our events, NOR convoys to shows, that has been made very clear.
If you drive like an idiot, then you will have problems.
SGT Oliver has kindly offered to come online later today to answer any questions you may have, so if you have any questions fire away.. Serious questions only please..
IN THE NOTTINGHAM COUNTY COURT
BETWEEN
NOTTINGHAMSHIRE COUNTY COUNCIL
Claimant
and
ALL PERSONS
INJUNCTION ORDER
IF YOU HAVE BEEN SERVED WITH A COPY OF THIS ORDER AND
YOU DO NOT OBEY IT YOU WILL BE GUILTY OF CONTEMPT OF
COURT AND YOU MAY BE SENT TO PRISON
On the 14th day of June 2007 the Court considered an application for an
injunction.
The Court ordered that:
1
All persons are forbidden from participating in a car cruise within the
County of Nottinghamshire. This order applies to persons who have
been served with a copy of it.
2
Any person served with a copy of the order has permission to apply to
the Court to vary or discharge it.
3
The provisions of Schedule 1 to this order shall apply.
4
The expressions "car cruise", "participating in a car cruise" and
"County of Nottinghamshire"have the meanings set out inSchedule 2
to this Order.
5
These orders shall remainin force until 5:00 p.m. on 14th June 2009.
If you do not fully understand this order you should go to a solicitor, legal Advice Centre or a Citizens' Advice
Bureau.
Schedule 1
The requirements referred to in paragraph 1 are as follows:
1
Service of this Order shall be effected by an officer of the
Nottinghamshire Police Service, who shall record the name and
address of the person upon whom the order is served and shall
communicate the same together with the time and date of service to
the Claimant.
2
At the same time that this order is served, the person served shall be
given an explanatory notice in the form attached to this Schedule.
3
The Claimant shall serve a copy of the application for an injunction
herein, together with the statements in support upon any person
served in accordance with the provisions of this Schedule. Such
service shall be effected by first class post, no later than 7 days after
service of the Order. The Claimant shall not be required to served
copies of the DVD evidence relied on.
4
The Claimant shall notify the Court that service of this Order, the
application for an injunction and the statements in support has taken
place, the name and address of the person served and the time and
date of service of the Order.
5
The Court will then consider by a Circuit Judge whether to add the
person served to the proceedings as a named Defendant and whether to
make any further order.
EXPLANATORY NOTICE
You have been served with an injunction.
If you take part in a car cruise anywhere
within the County of Nottinghamshire, you
will be in contempt of court and you may
be sent to prison.
You will receive additional information by
post within the next week.
Schedule 2
(a)
A car cruise is an event at which the drivers and passengers of 5 or
more motor vehicles congregate together or drive in convoy or race
each other upon the highway, so as by their conduct to make
excessive noise, cause danger to other road users or risk of injury to
any person or risk of damage to property.
(b)
Participating in a car cruise refers to drivers of vehicles or their
passengers conducting themselves as described in paragraph (a).

The County of Nottinghamshire is the area outlined in black on the
plan attached to this Schedule but does not include the City of
Nottingham where separate provisions apply.

Sgt oliver, please define "car cruise"
as you told us that we'd be ok going to our events or convoying to a show..
what do your collegues define as a "car cruise" ??
a meeting of people in a car park?
as we have a weekly meeting at early doors too.. is this now gonna be a hotspot for injunction weilding police officers?
apart from that, and as long as this is only to be applied to the nob heads that make us all look bad, then i welcome it

will it effect convoys to legel events in notts such as MFN?
and focusowners often hold meets in notts will these be affected?

I think if your being a nucience, i.e. ragging your car, driving over the speed limit, driving in high revs then YES your gonna get slapped..
If you are going somewhere like our legal LSOM meeting at stags, or our weekly meeting in mansfield at early doors, then you should be OK.
I feel this has stemmed from J27, and the issues casued up there by everyone meeting up.
So no doubt if you have to go PAST J27 on your way to MFN, then your probably gonna get stopped and in trouble.
The solution is, just drive normally. Take it easy, and dont rag it about..
Not only are you helping reduce emissions, your also not gonna get stopped, fined, or even jailed.

ok, so if you drive a modified car your more likely to get pulled, thats always been the same, no different now to 5 years ago!
in my opinion and maybe most of you on here, when you spend the time and effort in modifying your car, you dont want to rag it and race dangerously! where as if you drive a ratted micra that costs about a tenner to insure with 11 points at 17, then your gonna rag it.
basically the police dont target the standard motors, but the ones that look different get it in the neck....

The police have to look at it from everyones point of view..
To me and you, a loud exhaust and a dump valve is cool as a cucumber...
To the police, they see it as noise polution - as they'll recieve complaints from residents of the affected areas - and they CANNOT ignore them as TECHNICALLY you'd be breaking the law..
Again, im NOT SAYING I AGREE.. im telling you how it is!
Also, i agree - i bet most of the cars on maxxd are safer and looked after more than your averige car on the road..
BUT thanks to the select few who stick 3 alloy wheels on a corsa, put massive bodykits with cracks in it on their car and have bits hanging off and dodgy brakes and lights.. All modified car lovers are deemed a nucience..
Its like football for example.. To a none football supporter/follower their opinion is that football + men + beer = fighting & hooliganism
To some football fans, thats a ridiculas statement as its only a select few who fight and cause a nucence..
But when riots kick off, they dont clear out the whole football staduim do they!
They just eject the people who are being a nucence.
Why cant this rule apply to modified car lovers too?
And just eject and make a scene out of the trouble makers, and let us do what we do in peace.

(a)

If you do the above in part (a) but not do the part which is highlighted then you are not going to get pulled for not complying to the injunction.
Or is that too simple :confused:

Your right ted, if we didnt do the latter, then ACCORDING TO THE INJUNCTION... we'd be ok!
BUT
How do they decide if we are out to make noise, cause danger or injur people? etc?
I can see it being a case of the police using their own judgement, and therfore EVERYONE just being done

I'm not gonna clean this thread up, as i think all opinions should be heard.
All members are allowed their say. That said, it's starting to get out of hand.

lol i was working this thread as you locked it.
I've cleaned the thread up just to contain posts that look like valid questions and split the posts that are blatently having a dig at the police.
I've not deleted the posts but just split the off in the the mods forum so that olly/dave can decide what they want to do with them.

can i ask, would the police prefer people went into a pub to gather and socialise, and injure/kill someone on the way home due to having alcohol, rather than meeting in a empty carpark, away from main roads and alcohol.??
also, why do cars get pulled that have been PNC checked and obviously look maintained to a high standard? many modified cars are well looked after as they are used to promote products and clubs on show stands.

i would imagine there would be a few police knockin about, but with Maxxd havin good relations with them i would hope discretion being the part of valour, they would leave most people alone! Unless you have the jobsworths out!!
